¿Qué iniciativa legislativa tenemos? ?Qué iniciativa legislativa necesitamos? El art. 87.3 CE y la LOILP 4/2006 a debate

Abstract:

The social crisis of legitimacy that concerns to the representative institutions needs to find out for new and constructive legal solutions. The critical analysis of the material content of the legislative initiative established in the CE and the LO 3/1984 may provide some useful solutions that contributes to recover the social credibility in the institutions. We affirm the malfunction of the legislative initiative as a citizen participation right within the representative institutions as well as it is necessity to be improved. Our proposal involves two related fields: a) the reform of the 87.3 CE that removes the material limits as well as reduce the procedural ones; b) the legal reform that reinforce the role of the Comisión Promotora in the different phases that composes this right.
