El derecho a la vida y sus límites: la regulación penal del aborto en España y Brasil

Abstract:

The current article makes a research over the abortion legal regulation in the Spanish and Brazilian legal systems. To discuss in a minimum seriously way about the abortion requires to take a double approach: a) to ponder the group of pregnant women rights (as health and privacy rights) with the possible right to life entitlement by the nasciturus; b) to establish the capacity of intervention of the legal authorities related to the abortion. Indeed, the present article pretend to get three related goals: to contextualize, to compare and finally to clarify the principal differences over the legal positions about the abortion in Spain and Brazil taking into consideration both point of view, the constitutional and the criminal one.
