Los derechos políticos en España y Brasil: una aproximación en perspectiva comparada

Abstract:

The current paper undertakes a research over political rights having both, the consti- tutional and its legal complementary regulation, the Spanish and Brazilian systems as key references besides considering them, in a jurisprudentially and doctrinally way, as founding pillars of the demo- cratic estate. Taking its systematic centrality as the starting point, this paper pursues three related goals: to make an analytical approach on the political rights founding theoretical principles: the democratic and people’s sovereignty; rethink its entitlement’s suitability founding parameters and, nally, analyze both the jurisprudential praxis and the current mechanics on political participation emphasizing the systemic incoherency between the participative democratic system constitutionally designed and the restrictions imposed by the constitution and the legal regulation.
